ABSTRACT
Reconciliation is an alternative solution method regulated by Criminal Procedure Law numbered 5721. Nonaccidental injury caused by occupational accidents is considered one of the offenses under the scope of the reconciliation. In the case of achieving reconciliation, a suit for claims cannot be filed or if there is any open case for claims, it would be considered forfeited as per the article 7/6th of the Reconciliation Regulation. Due to the regulation, it is possible to ensure the legal requirements are met via reconciliation without a separate claim for damages; as during the reconciliation process any pecuniary and non-pecuniary damages available through filing a suit can be satisfied by the employer offering the required amount to the employee who has had an occupational accident. In practice, employers may offer amounts rather lower than those that might be settled in a lawsuit as the reconciliation action and employees in an economically weak position may consent to these lower amounts. Thus, lesion and some forfeiture of rights may occur. The effects of the reconciliation in suits for damages regarding occupational accidents will be discussed along with forfeiting the lawsuit and lesion
