ABSTRACT
In recent decades Turkey looks like a country where the flow of immigrants decreased dramatically. Studies in this field reflect an important escalation in terms of numbers of unrecorded immigrants that captured by security forces. In terms of captured and detained unrecorded immigrant figures Turkey has remained at the front row among European countries. Due to wide territorial borders to Europe and Asian countries and conveniences of visa formalities Turkey is the only open gate to access to European countries comparing to countries which have heavy border controls such Italy and Spain. Beyond these, latest political developments in recent decades showed that immigrants which came from Eastern Europe, Central Asia and Africa have faced difficulties to pass in transit to West over Turkey. Although most of incoming immigrants aim to pass to Western Europe and the US, due to some difficulties such border controls, accidents etc. they stay Turkey and begin to participate in labour market. Unrecorded immigrants remained in Turkey are could not be deported for several reasons. As a result these immigrants have experienced with serious problems such health, security, education and family affairs. This paper tries to evaluate the current situation of immigrants who try to stay in Turkey unlawfully in terms of labour law and employment based on recent figures.
