The Examination of the Decision of the Supreme Court About Occupational Health and Safety Act

ABSTRACT

In this study, the case filed for action so as to annul some articles in Occupational Health and Safety Act, which the Supreme Court dismissed all the actions for annulment, is examined. The reasons of the action for annulment and the reasons of the decision of the Supreme Court are examined. In addition, the decision is evaluated in terms of the legal regulations

İş Sağlığı ve Güvenliği Kanunu’na İlişkin Anayasa Mahkemesi Kararının İncelenmesi

ÖZ

Bu çalışmada, 6331 sayılı İş Sağlığı ve Güvenliği Kanunu’nun bazı maddelerinin iptaline yönelik açılan davada Anayasa Mahkemesi’nce verilen karar incelenmektedir. Anayasa Mahkemesi incelemeye konu kararında, iptal taleplerini reddetmiştir. Çalışmada öncelikle iptal talebine ilişkin gerekçeler ile Anayasa Mahkemesi’nin red kararında yer alan gerekçeler özetlenecek, ardından yasal düzenlemeler çerçevesinde değerlendirme yapılarak görüşümüz belirtilecektir
